General terms and conditions
I. Conditions The following conditions related to use of the Website of ADINA Suisse GmbH, are to be accepted by the customer when clicking the related confirmation field and otherwise. (The following conditions are accessed through the website of the ADINA Suisse GmbH electronic orders, they are accepted by the customer by clicking the appropriate confirmation field or otherwise.) They apply in the absence of any other agreement, as well as for customer's follow-up business with ADINA Suisse GmbH, that is not conducted over the the Website.
The right to return does not exist and is, in terms of legalities, excluded.
II delivery schedules
The ADINA Suisse GmbH strives to deliver ordered goods in Switzerland, within 20 days and in Germany within 30 days, to the customer. If the delivery date is delayed by more than 8 days, ADINA Suisse GmbH will advise the customer. In this case, the customer has the right to cancel the contract. The purchase price and any additional fees charged to the credit card, will be returned.
III. Prices
Prices are inclusive of VAT, transport costs and customs fees.
IV Delivery, risks associated with shipping, testing of the product
The products ordered are to be delivered to the customer's address, as ordered by the customer on the Website and fully insured by us. At this time, ownership and risk are transferred to the buyer. The customer is responsible for immediate checking and subsequent approval of the purchased objects. Incorrect deliveries or deficiencies are to be reported in written and returned to the seller within 5 working days; hidden defects immediately upon discovery. 2 years after delivery, the legal rights of the buyer cease.
If the customer's claim of deficienct delivery is found to be just, the customer is entitled to replacement or to rescind the contract. In both cases, Article II of these conditions apply.
If the goods have been accepted, the guarantee of the customer's rights, pertaining to defects, are forfeited.
V. jurisdiction and applicable law
The contract is governed by Swiss law. Jurisdiction for disputes arising from this contract is the city of Zug, where by the seller has the right to choose the location to file legal proceedings. |
